Legally Exempt Child Care Services

The Child Care Council has been enrolling Legally Exempt child care programs since the year 2000.

Legally Exempt child care programs are usually family and friends that wish to provide child care for children whose parent(s) are eligible for the Child Care Assistance Program. Other Legally Exempt programs would include early childhood programs that are not required by NYS to be licensed or registered.

The parent eligible for the Child Care Assistance Program completes a Provider Form (obtained from our office or located under the “FORMS” section of our website) and turns this into their Subsidy caseworker. The Legally Exempt Specialist sends an enrollment packet to the Legally Exempt Provider for completion. The Council staff provide technical assistance and support throughout the process and conduct site visits to ensure the program meets the requirements and is maintaining the required documentation.
